  1. Overview

Thank you for choosing Mbawa Oasis Company Limited for your travel experiences. These Terms and Conditions govern all bookings, reservations, and Services provided by our company. They also include our refund policies, which apply after payments have been made. By engaging with our Service, you (the “Customer”) agree to be bound by these Terms.

  1. Definitions
  • Customer: Any individual or entity that books or purchases services from Mbawa Oasis Company Limited.
  • Service: Any tourism package, trip, event, or associated service provided by the Company.
  • Payment: Any fee, deposit, or amount paid by the Customer towards the booked Service.
  • Cancellation: A formal request by the Customer, or a decision by the Company, to revoke the Service booking.
  1. Booking and Payment
  • Booking:
    • All bookings must be made in advance via our website, authorized agents, or our office.
    • A deposit of 30% is required at the time of booking to secure your reservation.
  • Full Payment Requirement:
    • Full payment must be made by 30 days prior to the travel date.
  • Payment Methods:
    • We accept payments through wire transfer.
    • We also accept online payment transfers via a secure link provided through Pesapal. These transactions are secured by CyberSource to ensure the highest level of security for our customers.
    • Other accepted methods include [e.g., bank transfer, mobile payment, credit card] as indicated at the time of booking.
  • Non-Refundable Fees:
    • Certain fees (such as deposit fees, booking fees, or administrative fees) are non-refundable once Payment is made. These fees will be clearly stated at the time of purchase.
  1. Cancellations and Refund Policies

4.1 Cancellation Initiated by the Customer

  • Advance Cancellation:
    • If a cancellation is received in writing at least 30 days before the scheduled start date of the Service, a refund may be issued for the amount paid, less any non-refundable fees and an applicable administration charge (which may be 100% of the designated fee).
  • Late Cancellation:
    • For cancellation requests received between 15 and 29 days prior to the scheduled start date, a cancellation fee equal to 50–75% of the total Payment will be deducted.
  • No-Show or Last-Minute Cancellation:
    • Cancellations received less than 14 days to 24 hours before the start time—or a failure to appear (“No-Show”)—will not be eligible for a refund.

4.2 Cancellation Initiated by Mbawa Oasis Company Limited

  • Company-Initiated Cancellations:
    • If Mbawa Oasis cancels or postpones any Service due to unforeseen circumstances within our control, the Customer will be entitled to a full refund of all amounts paid. Alternatively, the Customer may opt to reschedule the Service at no additional cost.

4.3 Force Majeure

  • Exemption from Liability:
    • In events of force majeure—including, but not limited to, natural disasters, governmental restrictions, or other unexpected occurrences beyond our control—the Company shall not be held liable for non-refundable deposits or fees.
  • Force Majeure Refunds:
    • Refund eligibility during force majeure events will be evaluated on a case-by-case basis, based on the specific circumstances.

4.4 Refund Process

  • Request Submission:
    • Refund requests must be submitted in writing to our designated email address (or via certified mail) as provided in our Contact Information below.
  • Processing Time:
    • Once approved, refunds will be processed within 10 working days using the original Payment method.
  • Deduction of Fees:
    • Any approved refund will have the applicable non-refundable fees and administration charges deducted.
  1. Amendments and Changes
  • Right to Amend:
    • Mbawa Oasis Company Limited reserves the right to modify, suspend, or discontinue these Terms at any time. Significant changes will be communicated via the booking confirmation email or through our website notice.
  • Binding Agreement:
    • Continued use of our Service after any amendments signifies your acceptance of the updated Terms.
  1. Liability and Dispute Resolution
  • Limitation of Liability:
    • Mbawa Oasis Company Limited shall not be responsible for injuries, illnesses, accidents, loss or damage of personal belongings during excursions, or delays caused by third-party providers (such as transportation or accommodation services). We also are not liable for delays or failures to process refunds arising from technical issues, banking matters, or other circumstances beyond our control.
  • Dispute Resolution:
    • Any disputes arising from these Terms, including refund-related issues, shall be resolved in accordance with our General Terms and Conditions or through the appropriate legal channels under the jurisdiction where the Service was provided.
  1. Code of Conduct
  • Customers are expected to respect local laws, customs, and wildlife during all activities.
  • Any misconduct or breach of local regulations may result in the termination of Services without a refund.
  1. Privacy Policy
  • All personal information collected during the booking process is used solely for Service delivery and will not be shared with third parties without your consent.
  1. Health and Safety
  • Customers are responsible for ensuring that they are medically fit to participate in our activities.
  • Safety guidelines for each excursion or Service will be provided and must be always adhered to.
  1. Modifications to Services
  • Mbawa Oasis reserves the right to modify itineraries and/or Services due to weather conditions, safety concerns, or other uncontrollable factors.
  • Customers will be notified of any changes as promptly as possible.
  1. Governing Law
  • These Terms and Conditions are governed by and shall be interpreted in accordance with the laws of Tanzania.
  • Any disputes arising from these Terms shall be subject to the jurisdiction of the courts in Tanzania.
